1. Agreement to these terms

These Terms of Use apply to stashretailgroup.com (the "site"), run by Godtastic LLC d/b/a STASH Retail Group ("STASH", "we", "us"). By using the site you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.

2. Who can use the site

You must be at least 18 to send us a request. If you send a request for a business or property, you confirm that you are authorized to discuss it on that business's behalf. Nicotine products are sold only to adults 21 and older.

3. Hosting a machine

• No offer or contract. The site describes our program in general terms. Sending a request doesn't create an agreement, and we may decline any location for any lawful reason.
• The written agreement controls. Statements such as "$0 to host", "we pay you 10% of net sales", payout timing, placement requirements and the services we provide are summaries. The binding terms, including how "net sales" is calculated, are set only in a signed host agreement. If the site and your agreement differ, the agreement wins.
• No earnings promise. Sales depend on the location, foot traffic, product mix and other factors. We don't promise any level of sales or income.
• Location requirements. Placement depends on space, power, Wi-Fi or cellular connectivity, the property owner's approval, and licensing and local rules. Machines selling nicotine products are placed only where the law allows and may require permits, signage and age-restriction equipment.

4. Images, examples and listings

• Machine images are renderings or examples. Actual machines, screens, colors and branding may differ.
• Products shown are examples. What each machine carries varies by location and availability, and prices are shown at the machine.
• The STASH map on the site is an illustration of how locations may be shown. It isn't a list of current locations.
• Listings on Google Maps and other third-party platforms are controlled by those platforms. We can't guarantee that a location will be listed, how it will appear, or that a listing will bring more customers.

5. Machine purchases

Purchases at STASH machines are covered by our Refund Policy and by the terms shown at the machine. We may refuse or cancel a sale, including any sale we believe breaks age-restriction laws.

6. Our content and trademarks

The site's text, design, logos and original images belong to Godtastic LLC or its licensors and are protected by copyright and trademark law. You may view and share links to the site for personal or business evaluation, but you may not copy, sell or reuse its content without our written permission.

Pokémon is a trademark of Nintendo, Creatures Inc. and GAME FREAK inc. Geek Bar, ZYN and other product names and packaging shown are trademarks of their respective owners. They are used only to identify products that may be sold in our machines. STASH is not affiliated with, sponsored by or endorsed by these companies.

7. Acceptable use

Don't use the site to send false information or spam, try to break into or disrupt the site or its services, upload malicious code, scrape it in bulk, or do anything unlawful.

8. Third-party services and links

The site uses outside services, such as address suggestions from Photon (OpenStreetMap data) and links to other websites. We don't control them and aren't responsible for their content or practices.

9. Disclaimer

The site is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the site will be error-free or always available, or that its information is complete or current.

10. Limitation of liability

To the fullest extent allowed by law, STASH and its owners, employees and agents won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site. Our total liability for any claim about the site is limited to $100. Some laws don't allow these limits, so they may not apply to you. Nothing in these terms limits liability that can't be limited by law.

11. Indemnity

If you misuse the site or break these terms, you agree to cover the reasonable costs and losses, including legal fees, that we incur as a result.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute about the site will be brought in the state or federal courts located in Orange County, Florida, and you agree to their jurisdiction.

13. General

If any part of these terms can't be enforced, the rest stays in effect. Our not enforcing a term isn't a waiver. We may update these terms by posting a new version here with a new date. Continuing to use the site after that means you accept the update.
